Kafunta Africa Tours Terms and Conditions

Terms and Conditions

Kafunta Africa Tours undertakes to provide all services offered subject to the terms and conditions contained herein, which are accepted by the client.  Please read carefully before using our services (including this website).

 

Booking

Quotations and bookings will only be accepted in writing, via e-mail.  Quotations are valid for a period of 14 days.  We try our best to respond to bookings, request for quotations and other queries within 24 hours.  Please contact us directly or resend your request if you do not receive a timeous response.  We do not accept provisional bookings, we will supply quotations and confirmed bookings.

Please note that emails are checked between 08:00 and 17:00 (South African time) Monday to Friday and 09:00 to 13:00 (South African time) on Saturdays.  If you require urgent assistance outside of those times then please contact us on our emergency number (+27 83 454 1914 and note you may be liable to charges by your telephone service provider).

Types of Tours

  • Scheduled Tours
    • You will share transportation with other guests in an air-conditioned vehicle, either a 12 seater mini-bus or a 30/40 seater coach.
    • Pickups are from and Drop-offs are at your accommodation and times will vary depending on the location of the accommodation.
    • The Guides time will be shared with all guests.
    • The Itinerary will have a fixed timetable.
  • Private Tours
    • Pick up from and drop off at your accommodation.
    • The air-conditioned vehicle is assigned for your exclusive use and you will not share with other guests.
    • The Tour Guide is assigned exclusively to you for the duration of the tour.
    • Your time is flexible (Up to a maximum of 8 hours)
    • Your Itinerary is flexible (Selected from our Itinerary items).

 

Payment Terms

 A 50% deposit is payable on confirmation of the service with the balance due 7 days prior to the commencement of the service unless other arrangements are agreed with Kafunta Africa Tours.  All prices are valid up and including 30 September 2019.

 

Amendment & Cancellation Policy

  • Only written amendments and cancellations received by Kafunta Africa Tours will be considered.
  • Amendments and/or Cancellations received 7 or more days prior to Tour Date will not incur any cancellation fee.
  • Amendments and/or Cancellations received between 2 and 6 days prior to Tour Date will incur a cancellation fee of 50% of the total value of the booking.
  • Amendments and/or Cancellations received 1 to 2 days prior to Tour Date will incur a cancellation fee of the total value of the booking.

 

 

Delays and Unforeseen Circumstances

 Kafunta Africa Tours will not be responsible for the consequences of any delays whether arising from accidents, breakdowns, or any other cause.  While we strive to stick to agreed itineraries and routes, Kafunta Africa Tours reserves the right to alter such agreed itineraries and routes due to unforeseen circumstances.

 

Health

 The client accepts that to participate in the tour requires a measure of physical fitness and health and it is the client’s obligation to ensure that they are medically fit to embark on the tour.  Kafunta Africa Tours suggest that you contact your local GP for health information on the visiting country prior to departure.

Luggage

 Kafunta Africa Tours and their staff will not be held responsible for any loss or damage to guest’s luggage or personal effects.  All luggage and personal effects are at all times the guest’s responsibility and the Kafunta Africa Tours does not accept any liability for any loss or damage of any personal effects, whatever the cause. No unaccompanied luggage or personal effects will be transported by Kafunta Africa Tours unless a written indemnity is received prior to transportation. On extended overland tours, 1 piece of luggage per person is allowed.

 

Insurance

  • Kafunta Africa Tours holds the required Passenger Liability Insurance and all vehicles are covered by adequate insurance.
  • All our guests are advised that it is their sole responsibility to have adequate comprehensive travel insurance and to be aware of the conditions attached to such insurance policy.

 

Limitation of Liability

 Kafunta Africa Tours shall not be held liable for any and all claims, losses, damages and/or costs, howsoever caused, arising directly or indirectly from these Terms and Conditions and any tours operated or organised by Kafunta Africa Tours. Nothing in this Agreement shall operate so as to exclude or in any way limit the Guests’ or Kafunta Africa’s liability for fraud, or for death or personal injury caused by either’s negligence or any other liability that may not be excluded or limited as a matter of law.

 

Law Applicable

 In respect to any claims and disputes which may arise between Kafunta Africa Tours and their guests, the law of the Republic of South Africa and the Courts of the Republic of South Africa shall have sole jurisdiction.

 

Disclaimer

 Kafunta Africa Tours, their employees, agents and associates shall not be responsible for and shall be exempt from any liability in respect of any loss, damage, injury, accident, delay or inconvenience to any person or their luggage or other personal property whether the same shall occur and whether the same shall arise from or be occasioned by the negligence of Kafunta Africa Tours, their employees, agents, associates and other persons indirectly in the employ or service of Kafunta Africa Tours or otherwise under any circumstances whatsoever.
